Something Borrowed Terms & Conditions
Hello SB Babes! Ready to step into the world of chic rentals? Before you take the plunge, let's go over the nitty-gritty of our terms and conditions. By using our site and services, including renting attire, you're agreeing to these terms - so give them a thorough read!
Service Description and Eligibility:
Our service allows you to rent clothing for defined periods. To partake, you need to be at least 18 years old with a valid payment method. When you engage with our services, you're confirming your age and your legal capacity to agree to these terms. Certain clients may not be permitted to rent dresses from Something Borrowed at the discretion of the company. This decision may be based on previous rental history, instances of dress damage, failure to return rented items, or any other factors deemed relevant by Something Borrowed. The company reserves the right to refuse business or rental services to any client without providing a specific reason.
Rental Process:
Ready to borrow something? Here's how it works. You select an item, specify the rental duration (4 or 8 days), check out and complete your payment. We'll charge your payment method for the rental cost and any applicable fees. Additionally, we'll need authorization to charge your payment method for the retail value of the rented pieces if necessary. It's paramount that you maintain the items and return them in their original condition. Failure to do so might entail payment of the retail value for damaged beyond repair or lost items.
Rental Period:
Your rental period is 4 o4 8 days. This begins on the day you've booked out the items and concludes on the the 4th or 8th day depending on which rental period you've chosen. If you exceed the stipulated return time, a late fee of 50% of the rental fee per day, up to the retail value of the item(s), will apply. You're responsible for returning the items promptly and settling the late fee.
Extending the Rental Period:
Love the clothes so much that you want to keep them longer? You can request an extension, but we can't guarantee we'll be able to grant it. If possible, an additional fee will be required. In the event of failure to return the items within the extended rental period, you'll incur late fees and/or replacement fees as outlined in these terms and conditions.
Delivery:
We deliver nationwide within South Africa. We'll deliver the items to the specified address on the day you've indicated. Please ensure a representative is present to receive the delivery. Failure to do so might result in additional delivery charges. While we do our best to ensure timely deliveries, unexpected shipping delays may occur. If the delivery of your rental garment is delayed and you receive it after your event date, please notify us immediately. In such cases, you may opt for a full refund of the rental fee, or, if applicable, a credit towards a future rental. Unfortunately, once an event date has passed, we cannot provide retroactive refunds or compensation if you choose not to inform us in time. If, due to our or the courier's negligence or fault, the wrong clothes are delivered, or the clothes are not fit for use, you can opt to extend the rental period, receive a partial rental fee refund, or obtain a full rental fee refund and cancel the rental.
No courier collections will be made on Saturdays or Sundays, so if you rent on a Thursday, we collect on a Monday and you get an extra day on us.
Your item will be delivered on or before the delivery date you selected when making your booking. Please make sure that for nationwide deliveries, you are aware that it takes 2 Business days to arrive so please do factor that into your choice of your rental start date. This delivery date marks the first day of your 4-day rental period. We recommend choosing a date that is 2 days prior to the date you intend to wear the item. This allows ample time for any adjustments, styling, or last-minute preparations, ensuring you look and feel your best for your special occasion.
As soon as your item is dispatched from our studio, you will receive an email from us. This email will contain a tracking number for the courier company handling your delivery. Simply enter the provided waybill number on the courier's website to track the status of your package.
If you haven't received the dispatch notification and tracking number 24 hours before your expected delivery date, please reach out to us as soon as possible. We're here to assist you every step of the way and ensure a smooth and seamless rental experience.
Shipping fees are calculated based on the rental period and location of each item in your cart. If multiple items are booked for the same rental period, one shipping fee applies. However, if items are rented for different periods, shipping fees will be charged per rental to cover separate courier trips. Please contact us or leave a special note on your order should you wish to rent for two different rental periods. We will send you a payment link via Payfast to settle the 2nd courier fee.
Size Matters:
We get it - sometimes the size just isn't right so please make use of our size guide. Each of our items have measurements available from the brands website that can help you make an informed decision on the fit. If you notice that the Clothing you received isn't fitting you like a glove, you need to let us know within 4 (four) hours of receiving your delivery. You can either request another size (if we have it in stock, of course) or you can return the item. If you decide to return the item due to a sizing issue, we'll issue you a gift card for the rental amount, minus the cleaning and delivery fee.
Returning the Clothing:
Hey, we totally get it - life gets busy! But when it comes to returning the clothing you've hired from us, we need you to be available at the delivery address provided at the time you made the Hire. This way, the courier can collect the clothing from you without any issues. If you're not available, Late Fees will apply. If you need to make alternative arrangements for the return of the Clothing, just let us know and we'll see what we can do (no promises though!). Please ensure that all personal belongings, such as jewelry, accessories, or other valuables, are removed from the dress and garment bag before returning it. Something Borrowed cannot be held responsible for any items left in the garment or bag once it has been collected or returned to us. Any found items will be held for 14 days, after which they will be donated or disposed of if unclaimed. Please put your rented garment back into its envelope or garment bag with the hanger and our courier will collect it from you and do the rest. Just remember, the general cleaning of your item is included in your rental fee so no need to do any washing etc.
If you've chosen to collect your dress rental, you're responsible for ensuring its safe return to our studio, whether you personally deliver it, use a friend, another delivery service, or Uber Connect. Something Borrowed cannot be held liable for any loss, theft, or damage during the return process, and return costs are your responsibility. Similarly, if you've arranged for courier collection and aren't available at the scheduled time and location, you must ensure the timely return of the rented item to our studio using any means necessary, whether it's yourself, someone else, another courier service, or Uber Connect. Something Borrowed will not be held accountable for any loss, theft, or damage resulting from alternative return arrangements.
Late Returns:
If you exceed the stipulated return time, a late fee of 50% of the rental fee per day, up to the retail value of the item(s), will apply. Should the items not be returned by 17:00 on the 5th day, you will automatically be billed for the next days late fee and so on and so forth for the number of days it takes to be returned. You're responsible for returning the items promptly and/or settling the late fee.
Cleaning:
The cleaning of your item is included in your rental fee so no need to do any washing etc. Our professional cleaning team ensures that every garment is thoroughly cleaned and maintained to the highest standards of hygiene and quality. We kindly ask our customers not to attempt any cleaning or washing of the rented dresses themselves. Our team is well-equipped to handle the cleaning process to preserve the garments' integrity and ensure they are in perfect condition for the next renter.
In the event of accidental stains or minor mishaps during your rental period, please refrain from trying to treat the stain or repair the garment yourself, as this may inadvertently cause further damage and charges. Instead, we encourage you to reach out to us immediately to report the issue.
Payment Options:
We know, we know - nobody likes parting with their hard-earned cash. But unfortunately, it's just one of those things! We accept payments via credit or debit card, as well as other payment methods that may be available on our website. By providing your payment information, you're authorizing us to charge your payment method for the rental fee, any applicable taxes and fees, and any other charges related to your use of our Services. No need to worry though, we promise to be gentle with your wallet! We do ask that you provide accurate and complete payment information, and update it if needed. If your payment method is declined, we may have to cancel your rental order and/or suspend or terminate your account. We reserve the right to change our accepted payment methods at any time without notice.
Cancellations and Return:
We acknowledge that plans change. If a cancellation occurs before the shipment date, it can be processed without complications. However, once items are shipped, cancellations are not feasible. Regrettably, we cannot issue refunds for early returns. Once the items are returned, a thorough inspection will be conducted. In the event of damage, we retain the right to charge your payment method for the retail value or a repair fee. Should the clothing not fit, notifying us within 4 hours allows for size adjustment or return. A gift card for the rental amount (minus dry cleaning and delivery fees) will be issued. An administration fee may apply.
Damage or Loss:
We're trusting you with our Clothing, so please take good care of it! We understand that minor mishaps can happen, but please note that the following types of damages may incur additional charges: stains (such as from food, drinks, or makeup), fabric snags or pulls, rips, and burns. To avoid additional fees, please take care when wearing and handling the dress. If any accidental damage occurs, please contact us immediately so we can assess the damage and discuss the necessary steps to repair the dress or determine if replacement fees will apply. Alterations to any rented garment are strictly prohibited without prior written consent from Something Borrowed. This includes, but is not limited to, hemming, resizing, pining, removing or adding straps, or modifying any part of the garment's structure. Unauthorized alterations will result in replacement fees or additional charges, as they may render the garment unsuitable for future rentals. As soon as you receive the Garment, please inspect it and let us know in writing of any damage, defect, or wear and tear of whatsoever nature to the Clothing. If anything happens to the Clothing while they're in your possession, whether it's lost or stolen, you're responsible for it. You also agree to pay us the Replacement Fees, as determined by us in our sole discretion, for any Clothing that is damaged or altered in any way for any reason whatsoever, whether due to your own fault or someone else's. If there are any Replacement Fees, Late Fees, or Administrative Fees that need to be paid, we reserve the right to charge your payment method for them, along with any other charges related to your use of our Services. We promise to act reasonably in determining the retail value of Clothing whenever it's needed, and we'll let you own the Clothing if you've paid all the Replacement Fees, Late Fees, and/or Administrative Fees (as may be applicable), but keep in mind that this "sale" is made on a voetstoots basis, and we make no warranty to you in respect of such Clothing.
Try- ons:
At Something Borrowed, we strive to provide our clients with the best possible experience when trying on our rental dresses. To ensure the smooth operation of our try-on appointments and to mitigate potential issues, we have implemented the following policy.
Booking Fee:
Effective immediately, we will be charging a nominal fee of R50 for all try-on appointments. This fee helps us cover our expenses, including staff wages and potential damages incurred during try-ons.
Fee Deduction:
The R50 try-on booking fee will be deducted from your rental fee should you book a dress within 7 days* of your original appointment. We believe this approach is fair and encourages clients to finalize their rental decisions promptly. Please note that this deduction will only be applicable if you attend your original appointment and book within the specified time frame.
Cancellation and Rescheduling:
If you need to cancel your booked slot, please notify us 24 hours in advance. While the booking fee is non-refundable after cancelling, we are happy to reschedule your appointment for a future date, subject to availability.
Dress selections: We understand that you'd love to try on specific dresses but due to the nature of dry cleaning, deliveries, late returns, written off dresses and garments that have already been booked out, we cannot guarantee that your desired dresses will be available for try on.
Quality Assurance:
This policy allows us to maintain the quality of our rental dresses and ensures that each client receives garments in pristine condition. It also helps us prevent no-shows and last-minute cancellations, which can disrupt our operations.
Privacy Policy:
Respecting your privacy is paramount. We encourage you to review our privacy policy for comprehensive information on data collection, usage, and protection.
Intellectual Property:
While we're thrilled to create engaging content, it's important to note that it remains our property or the property of our licensors. Reproduction, modification, distribution, or public display of our content requires prior written consent.
Disclaimer of Warranties:
Our commitment to delivering exceptional services and content is unwavering. However, they are provided "as is" and "as available," without warranties, express or implied.
Limitation of Liability:
While we aim for seamless experiences, unforeseen circumstances may arise. To the fullest extent permissible by law, we disclaim liability for indirect, incidental, or consequential damages.

Terms of service
Agreement to Terms
These Terms & Conditions govern your use of The Bag Baron website (the "Site") and your rental of The Bag Baron bags (the "Service").
By using our Site and Service, you accept these Terms & Conditions and agree to comply with them. This agreement is binding between you and us as soon as you make use of our service, become a member and/or log in to your account or use our Service.
By accepting these Terms & Conditions, you acknowledge that you have read, understood and agree to be bound by them.
Modification of Terms
We reserve the right to modify these terms and conditions at any time without prior notice.
Changes will be documented on our Site, and it is your responsibility to check the Terms & Conditions each time you use our Site or Service.
Account Registration
To rent bags from The Bag Baron, you must sign up on our portal, providing your name, address, valid South African ID number or Passport number, contact number, and payment details. In providing these details, you confirm that the information you submit is yours, accurate, complete and up-to-date.
You are responsible for maintaining the accuracy of your account information and for all activities under your account.
We reserve the right to decline any application at our discretion, without disclosing a reason.
It can take up to 2 business days for us to process an application for The Bag Baron membership. We will confirm the status of a membership application via email.
Applicants who are accepted to use and pay for the Service will be deemed as Active Members and will have an Active Membership unless terminated in accordance with these terms.
Orders, Payment and Charges
All payments must be made in South African Rand (ZAR) and are inclusive of South African VAT.
You are required to ensure that your payment method has sufficient funds to cover the rental cost.
By agreeing to these terms, you authorize us to charge your payment method for any fees associated with your rental, including but not limited to the Rental Cost, late fees, and damage fees.
The Rental Cost is the full amount payable by you to rent the rental item for the Rental Period. If there are any additional costs payable by you this will be indicated to you by us at the time of rental.
In order to Rent any items you need to provide us with all the necessary information we require and deem necessary.
When placing your order to Rent any items, you authorise The Bag Baron to charge the Rental Cost immediately.
You will be redirected to our payment merchant, PayStack, an approved payment gateway for all South African Acquiring Banks.
We may ask you to either pay a deposit to cover possible Late Fees, Replacement Fees, or Administrative Fees or provide credit card details to charge these fees if necessary.
After payment of the Rental Cost has been received, we will email you all necessary information.
Limit on Rentals
Customers are limited to renting one bag at a time during the first six months of membership.
After the initial six-month period, customers may rent more than one bag at a time, subject to availability.
Delivery and Pickup
We offer delivery and pickup services, at the relevant delivery and pickup fee.
We will only deliver our bags once we have verified that your identification details (valid South African ID number or Passport number) to ensure security and trust for purposes of insurance.
We will only deliver our bags to the address authorised by you on the initial order.
It is your responsibility to be available at the agreed address and time for both delivery and pickup.
If you fail to meet the courier, additional delivery fees may apply.
Delivery is only available within South Africa.
Each parcel will be sent via a secure courier on a tracked and signed-for delivery service.
At the time of delivery, the customer is required to present a valid ID or passport. A photograph of the presented ID will be taken to verify the customer's identity. The Bag Baron reserves the right to refuse delivery if the customer fails to comply with this requirement.
If you fail to return the bag at the agreed time and location, additional fees for missed collection attempts will apply.
Bags, Use and Care of Bags
We source all our bags from vetted suppliers who vouch for their authenticity.
The bags are as described in the site’s listings. However, the photographs are not contractually binding. The bags may differ slightly from these photographs. By using our services you agree that these photographs are only indicative of the exact quality of the bag.
All rented bags will include a tracking device that remains the property of The Bag Baron. This device is used solely to ensure the safety and security of our bags during the rental period.
You must not tamper with, remove, or damage the tracking device in any way. Any tampering or damage to the tracking device will result in a penalty fee and may lead to further legal action if deemed necessary. The tracking device must be returned with the bag in its original condition.
The tracking device only monitors the location of the bag for security purposes and does not collect personal data unrelated to the bag’s whereabouts. By agreeing to these Terms & Conditions, you consent to the use of tracking devices in our bags.
In the event of loss or theft of the bag, the tracking device will assist in its recovery. You are required to inform us immediately if the bag is lost or stolen during the rental period. If the bag cannot be recovered, you will be liable for the replacement cost of the bag.
You must treat the rented bags with care and return them in the same condition as received.
Any alterations to the bags are prohibited without our prior written consent.
If you return a bag that is minimally damaged and/or damaged beyond normal wear and tear, you will be liable for the cost of repair or replacement.
We will use photography and video to record the condition of the bag each time it enters and leaves the business. This will be kept on our records and used as a comparison of condition and kept as evidence.
Late Returns
Bags must be returned by the end of the rental period.
Late fees apply for bags returned after the due date, calculated as an amount equal to the rental cost for the overdue period.
If a bag is not returned within 5 days after the rental period, we reserve the right to charge the replacement cost of the bag.
Cancellations and Refunds
If you need to cancel your rental, please notify us as soon as possible by emailing info@thebagbaron.com.
Cancellations made 10 or more working days before the rental start date will receive a full refund.
Cancellations made within 9 working days before the rental start date, but before the item has been shipped, will be eligible for a gift card to the value of the rental amount.
Once an item has been shipped or collected, no refunds will be issued.
Warranties and Representations
You warrant that you have the legal capacity to enter into and be bound by these Terms and Conditions. If you are a minor, you confirm that you have the consent of a parent or legal guardian to enter into this Contract. These Terms and Conditions constitute a valid, legal contract, which is enforceable against you.
Each warranty provided by you is a separate warranty and will in no way be limited or restricted by inference from the terms of any other warranty or by any other words in these Terms and Conditions. Each warranty is severable from the others, meaning that if one warranty is found to be invalid, the other warranties will remain in full force and effect. These warranties are deemed to be material to this agreement.
The Bag Baron does not provide any warranty (express or implied) or make any representation concerning the rental bags, including their quality, fitness for a particular purpose, or merchantability. The operation of the website is provided "as is," and we make no warranty regarding the website’s functionality, availability, or ability to meet your specific needs.
You acknowledge that you rent bags entirely at your own risk. You further agree that the bags may appear differently in reality than depicted on the Website due to various reasons, including lighting, photography, and screen display differences. The Bag Baron will not be liable for any perceived discrepancies between the online images and the actual appearance of the rented bags.you have the consent of a parent/guardian to enter into this Contract if you are a minor;
Damage and Repairs
You agree to take all necessary precautions to avoid damage to the rented bags.
If a bag is returned with damage beyond normal wear and tear, you will be charged a repair fee which includes a service charge and the cost of repairs.
If a bag is damaged beyond repair, you will be liable for the full replacement cost of the bag.
If a bag is lost or stolen during the Rental Period, you are responsible for notifying us immediately. In such cases, you are liable for the replacement cost of the bag.
We reserve the right to put your membership and any orders for subsequent bags on hold until the issue has been resolved.
Loss, Theft, and Counterfeit

During the rental period, you are responsible for the bag and must take measures to prevent loss or theft.

The Bag Baron provides insurance coverage, but you are responsible for the insurance pay-in amount in such cases.
We will conduct an investigation into any counterfeit, lost or stolen bags and may:

Return and Inspection
Upon returning the bag, it will be inspected for any damage or alterations.
You must ensure that all parts and accessories of the bag are returned in the same condition as when rented.
If the bag is not returned in the same condition, repair or replacement fees will apply.
Termination and Suspension of Service
We reserve the right to terminate or suspend your account and access to our Service at any time for any reason, including but not limited to breach of these Terms & Conditions or any fraudulent activity.
In such cases, you will remain liable for any outstanding fees or charges.
Events Beyond Our Control
We are not liable for any failure to perform our obligations under these Terms & Conditions due to events beyond our control, including but not limited to natural disasters, war, civil unrest, and disruptions in communication or transportation networks.
In such events, both parties shall work together in good faith to mitigate the impact on the provision of services.
Data Protection and POPIA Compliance
The Bag Baron is committed to protecting your personal information in accordance with the Protection of Personal Information Act 2013 (POPIA).
We collect, process, and store personal data as necessary for the provision of our rental services, and we take all reasonable steps to protect your personal information from unauthorized access or disclosure.
By using our services, you consent to the collection, use, and processing of your personal information as detailed in our Privacy Policy.
In the event of a data breach, The Bag Baron will notify the relevant authorities and affected individuals as required by POPIA.
You have the right to access, correct, or request deletion of your personal information that we hold. Such requests can be submitted to info@thebagbaron.com.
Governing Law
These Terms & Conditions are governed by the laws of South Africa.
Any disputes arising from these terms will be resolved in the courts of South Africa.
Miscellaneous
These Terms & Conditions constitute the entire agreement between you and The Bag Baron regarding the rental of bags and supersede any prior agreements or understandings.
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
